Appeals are usually a lengthy and extensive process that should only be entered into after a thorough risk/reward analysis. There is a “fast track” process in place for custody issue, however, even then the process is not what most would consider “fast.” Having an attorney who is experienced in the appeal process lessens the unknowns for you and gives you a realistic expectation of potential outcomes.

To give you the best advise, the attorney will need a copy of the order/decree that you think should be appealed. A thorough evaluation of the order is necessary to ascertain if there is any legal basis for an appeal. A legal basis for an appeal is different than being upset at the outcome of a hearing or trial. A legal basis for an appeal means that an order/decree is based on an error of fact or the application of the law by the judge. These are the issues that an attorney can identify and give you guidance on whether or not it is worth it for you to pursue an appeal.

The area of family law appeals applies to appealing final orders on custody, custody modification, child support, legal custody issues, a Decree of Divorce dividing up property and/or awarding spousal support, orders terminating parental rights, and any other final order in family law cases.
